Terms of Service for TruTone

Welcome to TruTone! These Terms of Service (“Terms”) govern your use of TruTone, an online guitar learning community. By accessing or using TruTone, you agree to comply with and be bound by these Terms. If you do not agree, please do not use our platform.
1. Who We Are
TruTone provides guitar learning resources, including video courses, quizzes, and a social media platform where users can share content and connect with others. Access to our services requires a subscription and adherence to these Terms.
In these Terms of Service, “We,” “Us,” and “Our” refer to TruTone, the platform providing online guitar learning resources. “You” refers to the user of the platform, which includes any individual who registers, subscribes, or uses TruTone’s services. “User(s),” “Client(s),” or “Student(s)” refers to any individual who accesses the TruTone platform, pays for a subscription, or participates in lessons or courses. These terms may be used interchangeably throughout this document to describe individuals engaging with TruTone’s services in any capacity.
By using TruTone, you acknowledge and accept these terms and the use of the aforementioned terminology.
2. User Registration & Age Restrictions
By signing up for TruTone, you confirm that you meet the eligibility requirements for your chosen membership type:
- Users under 13 may only register for the ‘Standard (U13s)’ or ‘Private Tutor Package (U13s)’ memberships. These users do not have access to TruTone’s social media features.
- Users aged 13 and over may register for the Standard Membership or Private Tutor Package, which includes access to all TruTone features, including the social community.
To ensure compliance with online safety regulations, TruTone restricts access to its community features to users aged 13 and over. If a user is found to have misrepresented their age, their account may be suspended or terminated.
2.1 Safety and Child Protection
TruTone is committed to creating a safe and supportive environment for all users, especially minors. As part of our commitment:
- TruTone is committed to adhering to all safeguarding policies and procedures to ensure the safety of all minors within our platform.
- All tutors working with users under the age of 13 undergo thorough Enhanced DBS (Disclosure and Barring Service) checks to ensure their suitability for working with children.
- Parental involvement is required for any users under 13, especially during 1-1 lessons and feedback sessions.
3. Intended Use
- Single Account Use: Each account is intended for use by a single individual. Sharing your account with others, including for the purpose of using the platform’s content or features, is strictly prohibited. Doing so may lead to suspension or termination of your account.
- Course Content: The videos and learning materials provided by TruTone are intended solely for your personal use to facilitate your learning of guitar. Distributing or sharing course content with others is prohibited and may result in account termination.
- Learning Commitment: Videos are designed to enhance your learning experience. However, it is your responsibility to commit to learning regularly and making the most of the resources provided to progress in your guitar studies.
4. Subscriptions, Payments and Tutor Feedback Sessions
Tutor(s): For the purposes of these Terms, “tutor” refers to a qualified individual authorised by TruTone to deliver 1-1 lessons or tutor feedback sessions. Currently, all tuition is delivered by the founder, Jack Forshaw.
4.1 Membership Tiers & Fees
TruTone offers the following subscription plans:
- Standard Membership (U13s) – £19.99 per month
- Standard Membership – £24.99 per month
- Private Tutor Package (U13s) – £69.99 per month (includes weekly 1-1 lessons)
- Private Tutor Package – £74.99 per month (includes weekly 1-1 lessons)
4.2 Payment Processing
Payments are processed securely through Stripe. By subscribing, you authorise Stripe to process payments on your behalf. TruTone does not store or manage your direct debit details.
4.3 Cancellations
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period, and no refunds will be provided for partial periods.
4.4 Tutor Feedback Sessions
As part of the Standard and Standard (U13s) subscription plans, TruTone offers personalised tutor feedback sessions every month. These sessions are designed to monitor your progress and provide tailored guidance to help you improve.
- Session Entitlement: Each student/client enrolled in the Standard or Standard (U13s) subscription is entitled to one, 30-minute tutor feedback session per month, delivered via video call.
- Session Content: During these sessions, the tutor will assess your playing, offer constructive feedback, and discuss key areas for improvement based on your recent progress and goals.
- Scheduling Sessions: Sessions must be scheduled in advance at a mutually convenient time for both the student and tutor. Scheduling can be arranged via WhatsApp, Email, or through the TruTone platform. Once a time has been agreed, both parties are expected to honour the scheduled session. If the agreed time becomes unsuitable for either party, they must inform the other as soon as possible to arrange a new time.
- Location: All feedback sessions will take place online via video conferencing software such as Zoom, Teams, or a similar platform. TruTone will confirm the preferred method prior to the session.
- Cancellation and Rescheduling: Clients/students must provide at least 24 hours’ notice to cancel or reschedule a feedback session. Sessions cancelled with more than 24 hours’ notice may be rearranged at a mutually convenient time. Sessions cancelled with less than 24 hours’ notice, or missed without notice, will not be refunded or rescheduled. If a tutor must cancel, it is their responsibility to offer an alternative time that suits both parties.
- Session Termination: Tutors reserve the right to terminate a feedback session at any time if a client/student engages in behaviour that is abusive, disrespectful, disruptive, or otherwise inappropriate. In such cases, the tutor will document the incident and inform the client/student of any next steps, which may include restriction from future sessions or termination of services without refund.
- Under 13 Users: For users under 13, parental involvement is required in either arranging or during feedback sessions to ensure a safe and supervised environment. Tutors working with users under 13 have undergone Enhanced DBS (Disclosure and Barring Service) checks to verify their suitability for working with minors.
- Session Data and Privacy: Tutors may take notes during feedback sessions regarding the students/clients playing, progress, and goals. These notes are stored securely and used solely to inform future guidance and teaching. Sessions will not be recorded unless explicitly agreed in advance for specific purposes (e.g. training or quality assurance).
- Exclusions: Tutor feedback sessions are not included in the Private Tutor Package or Private Tutor Package (U13s), as these students already receive individualised support through weekly 1-1 lessons.
4.5 Private (1-1) Lessons
Users on the Private Tutor Package and Private Tutor Package (U13s) subscription plans receive regular lessons with a private tutor every month. These lessons are designed to provide direct, focused instruction to help you improve your skills.
- Lesson Entitlement: Each student/client enrolled in the Private Tutor Package or Private Tutor Package (U13s) is entitled to the equivalent of one 30-minute 1-1 lesson per week for each paid month. This time can be used flexibly, either as one 30-minute session each week or as a single 1-hour session every two weeks, depending on the preference of the student/client.
- Lesson Content: Each lesson will be tailored to your individual needs, focusing on areas that require attention or new concepts you wish to learn.
- Scheduling Lessons: Lessons must be scheduled in advance at a mutually convenient time for both the student and tutor. Scheduling can be arranged via WhatsApp, Email or by messaging your tutor through the TruTone platform. Once a time has been agreed upon, it is the shared responsibility of both the client/student and the tutor to honour the scheduled session. If the agreed time becomes unsuitable for either party, they must notify the other as soon as possible to arrange a new mutually convenient time.
- Cancellation and Rescheduling: Students/clients are required to give at least 24 hours’ notice to cancel or reschedule a lesson. Lessons cancelled with more than 24 hours’ notice may be rearranged at a time that is mutually convenient for both the tutor and student. Lessons cancelled with less than 24 hours’ notice, or missed without notice, will not be refunded or rescheduled. In the rare event that a lesson is cancelled by a tutor, it is the responsibility of the tutor to offer an alternative time that is suitable for both parties.
- Location: Lessons will take place either online (via Teams, Zoom, etc.) or at a physical location, as agreed between the tutor and student. For users under 13, in-person lessons will only take place in appropriate, supervised environments and must be agreed upon by the student’s parent or guardian.
- Under 13 Users: For users under 13, lessons will be scheduled with parental involvement to ensure safety and appropriate communication throughout. Tutors working with students under 13 have undergone DBS (Disclosure and Barring Service) checks to ensure their suitability for working with minors.
- Lesson Termination: Tutors reserve the right to terminate a lesson at any time if a client/student engages in behaviour that is abusive, disrespectful, disruptive, or otherwise inappropriate. In such cases, the tutor will document the incident and inform the client/student of any next steps, which may include suspension of lessons, involvement of TruTone support staff, or termination of services without refund.
5. Content Guidelines
- User-Generated Content: TruTone allows you to share photos, videos, and other content related to your musical progress. By uploading content, you grant TruTone a worldwide, royalty-free license to display and distribute your content on the platform.
- Prohibited Content: You may not upload or share content that:
- Violates copyright, trademarks, or intellectual property rights.
- Contains offensive, hateful, or illegal material.
- Violates the privacy of others.
- Monitoring: TruTone reserves the right to review, remove, or restrict content that violates these Terms or applicable laws.
6. User Responsibilities and Warranties
By using TruTone, you agree to the following responsibilities and warranties:
6.1 Compliance with Laws and Policies
- You agree to comply with these Terms, our Privacy Policy, and all applicable laws.
6.2 Intellectual Property Rights
- You will not infringe or misappropriate the intellectual property rights of any third party.
6.3 Social Media Access & Responsibilities
- Users under 13 do not have access to TruTone’s social media features and cannot interact with user-generated content.
- Users 13 and over must ensure that their content follows community guidelines.
- Users encountering inappropriate content should report it for review.
6.4 Device and Content Safety
- Users are responsible for safeguarding their devices and exercising discretion when engaging with online content.
- TruTone is not liable for any harm caused by user-generated content.
6.5 Personal Conduct & Account Security
- Users must engage respectfully within the community. Harassment, spamming, or sharing inappropriate content is prohibited.
- You are responsible for maintaining the confidentiality of your account credentials. Sharing your login details is strictly prohibited.
7. Intellectual Property
- Platform Ownership: TruTone owns all rights to the platform, including its design, features, and content (except user-generated content). You may not copy, modify, or distribute any part of TruTone without prior written consent.
- Your Content: You retain ownership of any content you upload, but you grant TruTone the rights outlined above for its use on the platform.
8. Privacy
Your use of TruTone is governed by our Privacy Policy. By using the platform, you consent to the collection and use of your data as described in that policy.
9. Termination
- By You: You can close your account at any time by contacting support.
- By TruTone: We reserve the right to suspend or terminate your account if you violate these Terms, applicable laws, or engage in harmful activities on the platform.
10. Limitation of Liability
To the extent permitted by law, TruTone is not liable for:
- Any harm or damages resulting from your use of the platform.
- Loss of data, interruptions, or errors in the service.
- Content shared by other users.
11. Indemnification
You agree to indemnify and hold TruTone harmless from any claims, losses, liabilities, or expenses arising from your use of the platform or violation of these Terms.
12. Changes to These Terms
TruTone reserves the right to modify these Terms at any time. We will notify you of significant changes, and your continued use of the platform constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes will be resolved in the courts of England and Wales.
